Inaugurated in 1986, Luxembourg is one of the units of the Instituto Mário Penna and serves patients with health insurance, private and SUS. In 2016, he performed more than 1 million procedures, in the most diverse specialties.

RADIOTHERAPY
Treatment in which radiation is used to destroy a tumor or prevent its cells from enlarging. These radiations are not seen, and during application the patient does not feel anything. Radiotherapy can be used in combination with chemotherapy or other resources in the treatment of tumors.

Inaugurated in 1986, Hospital Luxemburgo is considered a reference in cancer treatment in Minas Gerais for being part of the Mário Penna Institute with more than 45 years of history in the fight against cancer. GENERAL VISIT INFORMATION:

RIGHTS OF PATIENTS WITH CANCER
The Federal Constitution assures that: “Health is everyone’s right and the State’s duty”. This means that everyone suffering from any disease, including cancer, is entitled to treatment by medical assistance agencies maintained by the Union, the states and municipalities.
Treatment includes consultations, medicines, surgeries, laboratory tests, CT scans, X-rays, ultrasounds, radiotherapy, chemotherapy and can be performed by the Unified Health System (SUS).
If the disease affects a minor, one of the parents or guardian has the right to remain with the child or adolescent, during the entire hospital stay, as determined by the Child and Adolescent Statute. Patients over 60 years of age are also entitled to a companion when hospitalized, as determined by the Elderly Statute.
The treatment, even when it is supported by the State, is expensive and requires the use of many medicines, food supplements, fiber and unconventional food. In order to cover these expenses, Brazilian legislation guarantees people with malignant neoplasms – cancer and other serious diseases – some special rights.
Diagnosis, treatment and remedies by SUS
The SUS must guarantee the diagnosis and the entire treatment of cancer, offering the following services: oncology surgery, clinical oncology, radiotherapy, hematology and pediatric oncology in a High Complexity Oncology Care Unit. The patient with malignant neoplasm will receive, free of charge, in the Unified Health System (SUS), all necessary treatments, being entitled to undergo the first treatment within 60 (sixty) days from the day it is diagnosed.
It is possible to obtain information about free medications at the health establishments themselves, which, in many cases, are responsible for the standardization, acquisition and distribution of medications.
FGTS withdrawal
In the symptomatic phase of the disease, the worker registered with the FGTS who has a malignant neoplasm (cancer) or who has a dependent patient with cancer may withdraw from the FGTS.
One of the required documentation is the medical certificate valid for no more than thirty days, counted from its issuance, signed with a signature on the stamp and CRM of the doctor responsible for the treatment, containing a diagnosis in which it reports the pathologies or illnesses that bother the patient, the current clinical stage of the disease and the sick.
In addition to these documents, it is necessary to bring the work card (in the event of withdrawal from a worker) or a certified copy of the minutes of the meeting that resolved to appoint a non-employed director; copy of the Articles of Incorporation registered at the Registry of Deeds and Documents or at the Commercial Registry, or proper act of the competent authority published in the Official Gazette; and Citizen Card or PIS/PASEP Enrollment Card.
It is essential to bring original and copy of all documents.
The amount received will be the balance of all accounts belonging to the worker, including the current employment contract account. In the case of a reason for disability related to cancer, and the symptoms of the disease persist, the withdrawal from the account can be made while there is a balance, provided that the necessary documents are presented.
Take the opportunity to request the PIS/PASEP release along with the FGTS release. They are basically the same documents and the request is made in the same unit of Caixa Econômica Federal (CEF)
PIS/PASEP withdrawal
PIS can be withdrawn at Caixa Econômica Federal and PASEP at Banco do Brasil by workers registered with PIS/PASEP before 1988 who have a malignant neoplasm (cancer), in the symptomatic phase of the disease, or who have a dependent patient with cancer.
To carry out the withdrawal, it is necessary to present a medical certificate valid for no more than thirty days, counted from its dispatch, signed with a signature on the stamp and CRM of the doctor responsible for the treatment, mentioning Resolution 01/96 of 10/15/1996 of the Board of Directors of the PIS/PASEP Participation Fund and diagnosis in which it reports the pathologies or diseases that bother the patient, the current clinical stage of the disease and the patient and expressly indicating “symptomatic patient for the pathology classified under the code of the International Classification of Diseases (CID)” (from 140 to 208 or from 230 to 234 or C00 to C97 or D00 to D09).
The worker will receive the full balance of his dues and income.
Sick Pay
It is a monthly benefit to which the insured is entitled while he is unable to work due to illness for more than 15 consecutive days. Cancer patients will be entitled to the benefit, regardless of the payment of 12 contributions, as long as they are insured. The incapacity for work must be proven through an examination carried out by the medical expertise of the INSS.
In order to have access to this assistance, the insured must go to the Social Security agency closest to their residence or call 135 to request the appointment of the medical examination. A work card or documents proving your contribution to the INSS is essential, as well as a statement or medical examination (valid for 30 days) describing the medical condition of the insured.
By disability retirement
Disability retirement is granted as long as the incapacity for work is considered definitive by the INSS medical expertise. The insured person who is not undergoing a rehabilitation process is entitled to the benefit to carry out an activity that guarantees his/her subsistence (regardless of whether or not he is receiving sick pay).
Cancer patients will be entitled to the benefit, regardless of the payment of 12 contributions, as long as they are insured.
INSS insured persons who need permanent assistance from another person may have their disability retirement amount increased by 25% in the situations provided for in Annex I of Decree 3.048/99.
Assistance Support for the Elderly and Disabled (Organic Law of Social Assistance – LOAS)
The Organic Law of Social Assistance (LOAS) guarantees a benefit of one minimum monthly salary to elderly persons aged 65 or over, who do not have a paid job, and to people with disabilities who are unable to work and to live independently. Children from zero to 10 years old and teenagers between 12 and 18 years old have the same rights.
To be entitled to the benefit, another fundamental criterion is that the family income must be less than ¼ (one quarter) of the minimum wage. This calculation considers the number of people living in the same household: spouse, partner, parents, children and siblings not emancipated from any condition, minors and disabled people. The income criterion characterizes the impossibility of the patient and his family to guarantee their livelihood.
The person with cancer is entitled to social support as long as they meet the criteria of age, income or disability described above. In cases where the patient suffers from an advanced stage disease, or suffers consequences of irreversible sequelae of cancer treatment, the benefit may also be used, provided that there is an implication of their health status in the incapacity for work and in the acts of independent life.
The applicant cannot be linked to any social security scheme or receive any benefits. Even when hospitalized, both the elderly and the disabled are entitled to the benefit. Assistance support is non-transferable and does not generate pension rights for heirs or successors. The beneficiary does not receive the 13th salary.
To apply for the benefit, the person must undergo an expert medical examination at the INSS. Information about the necessary documentation can be obtained by calling 135 or through the social security website.
Out-of-Home Treatment (TFD) in the Unified Health System (SUS)
SAS Ordinance No. 055, of February 24, 1999 aims to guarantee the access of patients from one municipality to care services in another municipality, or even, in special cases, from one State to another State. TFD may involve the guarantee of transportation for treatment and accommodation, when indicated. The GT will be granted, exclusively, to patients cared for in the public and referenced network. In cases where there is a medical indication, the payment of expenses for a companion will be authorized.
Income Tax Exemption on Retirement
Patients are exempt from income tax on income from retirement, retirement and pension, including supplements (RIR/1999, art. 39, XXXIII; IN SRF nº 15, of 2001, art. 5, XII). Even the earnings from retirement or pensions received accumulatively are not subject to taxation, and those who received the referred earnings are exempt (Law No. 7713, of 1988, art. 6, item XIV).
To request the exemption, the person must seek the agency that pays their pension (INSS, City Hall, State, etc.) with a request provided by the Federal Revenue. The disease will be proven by means of a medical report, which is issued by the official medical service of the Union, the States, the Federal District and the municipalities, with the period of validity of the expert report being fixed, in cases subject to control (Law No. 9,250, of 1995, art. 30; RIR/1999, art. 39, §§ 4 and 5; IN SRF nº 15, of 2001, art. 5, §§ 1 and 2).
Good to know:
– The value of the purchase of orthosis and prosthesis can be deducted from the annual income tax return.
– If the exemption is requested after some time of illness, it is possible to request a refund of Income Tax, limited to five years.
Discharge of financing for the homeowner’s house
Persons with total and permanent disability, caused by accident or illness, are entitled to discharge, if this clause is included in their contract. For this, he must be unfit for work and the illness determining the incapacity must have been acquired after signing the property purchase contract.
Included in the installments of the property financed by the Housing Finance System (SFH) is an insurance that guarantees the payment of the property in case of disability or death. In case of disability, this insurance covers the amount corresponding to the patient’s share of the financing. The financial entity that financed the property must forward the necessary documents to the responsible insurance company.
Exemption from IPI on the purchase of adapted vehicles
The IPI is the federal tax on industrialized products. Cancer patients are exempt from this tax only when they have a physical disability in their upper or lower limbs that prevents them from driving common vehicles. It is necessary for the applicant to submit exams and medical report describing and proving the disability.
The vehicle must have special characteristics, original or resulting from adaptation, that allow its proper use by people with physical disabilities. Among these features, the automatic or hydraulic transmission (actuated by a hydraulic system) and the hydraulic steering.
Vehicle adaptation can be carried out at the assembler itself or at a specialized workshop. The IPI will normally cover any optional accessories that are not original equipment of the vehicle purchased. The benefit can only be used once. But if the vehicle was purchased more than three years ago, it can be used a second time.
Law No. 10,182, of 02/12/2001, restores the validity of Law No. 8,989, of 02/24/1995, which provides for the exemption from the IPI on the acquisition of cars intended for the autonomous transport of passengers and for the use of vehicle holders. deficiency. Priority Judicial Progress
The Code of Civil Procedure was recently amended to grant priority progress in any process (civil, criminal or labor), in any instance, to all persons aged 65 years or over, that is, the process of these persons must proceed a little faster than the others. The Elderly Statute lowered the age to enjoy this right for those aged 60 and over and, in addition, the Statute extended the right to administrative processes and procedures.
In other words, the sick person suffering from a serious illness who has any lawsuit in court, against any person, public agency or company, receives the benefit of faster progress. For this, it is only necessary to make an application demanding your right. Even if the patient is under 60 years of age, he/she may apply for the benefit, as he/she has a lower life expectancy, due to the serious illness that he/she is suffering from. The request must be made by the lawyer who handles the process and depends on the judge’s order. If the judge grants the request, the judicial process may end sooner than usual and the patient, if he wins the case, may enjoy the judicial decision.
Breast Reconstruction Surgery
Every woman who has had one or both breasts amputated or mutilated as a result of cancer treatment is entitled to undergo plastic surgery for breast reconstruction, when properly recommended by the responsible physician. In the case of cancer patients who are covered by a private health plan, mandatory coverage is provided for in Federal Law 10,223/01, which amended Federal Law 9,656/98. Said legal provision contemplates, in its article 10-A, that health care providers are obliged, through their network of affiliated units, to provide the service of reconstructive plastic surgery for the breast, resulting from the use of the cancer treatment technique used . On the other hand, the Consumer Protection Code (Law 8078/90) recommends that the cases of contractual exclusion raised by operators and insurance companies must be written clearly (Article 46) and, when in doubt, interpreted in the most favorable manner for the consumer (Article 47).
